  26. Distributing Marionet
  27.  
  28. Once you have created a product or solution with Marionet, you may wish to distribute it to others, either in a commercial or non-commercial form. Distribution of Marionet in a commercial form requires a license; some distribution in a non-commercial form also requires a license. This document explains the various options available to you.

The Marionet Development Kit is the retail package, you need it to develop applications that use Marionet. The Marionet Development Kit contains Marionet, the Marionet Manager, the full manual, examples, and a variety of other items of use in developing products and solutions using Marionet. Introductory pricing of the Marionet Development Kit is only $99. The licenses discussed below are needed if you want to distribute something you've developed to others.

  32. Allegiant offers several different licensing options depending on your needs:

  34.  • Trial Version of Marionet
  35.        Allows for Freeware/Shareware distribution. Anyone may distribute the Trial
  36.        version of Marionet without paying any fees or executing any special agreement.
  37.        After 30-days of use, the Trial Version converts to a more limited Lite Version.
  38.        The manual documents which commands will continue to work. For this free
  39.        licensing option, you will need to develop your product to work with the limited
  40.        feature set of the Lite version.
  41.  
  42.  • Commercial Distribution License
  43.       Allows inclusion of the Marionet application with your commercial product. Requires
  44.       execution of a license agreement with Allegiant and payment of fees.
  45.  
  46.  • Site and Network Licenses
  47.       Allows distribution of the Marionet and Marionet Manager applications within an 
  48.       organization, either on individual machines or through access to a workgroup server. 
  49.  
  50.  • Educational Licenses
  51.       Educational licenses are the same as Site/Network licenses but are provided at a 
  52.       substantial discount (50%) to qualified educational institutions.

  55. Non-Commercial Distribution (freeware/shareware)
  56.  
  57. Licensing policy:
  58. No license agreement is required. No fees are required.

  60. What may be distributed:
  61. The Marionet Trial Version as downloaded from the Allegiant ftp or Web site.

  63. Fees:
  64. None

  66. Restrictions:

The Trial Version is initially fully functional for 30-days. After 30-days the Trial version converts to a limited functionality Lite Version. The Lite Version may be  used for PERSONAL use only. The only exception is that users of freeware or shareware products that require Marionet, may continue to use the Lite version with those Freeware or shareware products that require it.

  69. The Trial Version MAY NOT be distributed with commercial products without the express permission of Allegiant. Distribution of the Trial version with a commercial product may require a Distribution License and payment of fees.

You may include the Marionet Trial Version with your product or direct your users to the Trial Version at our web site (http://www.allegiant.com/). You do not need to execute a license agreement to include the Trial Version with non-commercial products such as freeware and shareware utilities.

  75. The Marionet Trial Version is fully functional but converts to a limited functionality Lite Version after 30-days. See the Marionet 1.1 manual at ftp.allegiant.com for details on which features will continue to work.

  77. The Trial Version may be included on CD-ROMs or diskettes; may be posted on FTP and web sites; and may otherwise be distributed without licensing provided you distribute it unmodified as downloaded from our web site.

The Trial Version is an excellent compromise for shareware/freeware developers who do not wish to pay additional licensing fees and can live within the limitations of the Lite feature set. You can take advantage of the 30-day time out feature to provide a more complete product for evaluation and then when the Trial Version automatically converts to a Lite version, you can do the same with your product to encourage payment of registration fees. If you've also purchased a Distribution License, you can send your users the fully functional Marionet when you recieve your fee from them.

  89. Commercial Distribution

  91. Licensing policy:
  92. A licensing agreement is required. Payment of fees is required.

  94. What may be distributed:
  95. The Marionet application sent to you after executing a license agreement.

  98. Limited Distribution for a single title (up to 200 units): $149
  99. Limited Distribution for a single title (up to 750 units): $495
  100. Unlimited Distribution for a single title: $995

To distribute the commercial version of Marionet with your commercial product, you must contact Allegiant for a license agreement. After execution of the license agreement and payment has been received, Allegiant will provide you with a disk and license number. You will run the installer on the disk and enter your license number, the installer will make a master copy of Marionet which you can then include with your product.

  104. You may not distribute Marionet in an unrestricted fashion over the internet. Distribution must be restricted to your customers. Any electronic distribution must be private - either by email or through a secure web site or similar means.

  106. In a visible location in your product, such as an About Box or Splash Screen, you must include the following text:

  111. The same text must also appear wherever you list copyright information for your product - such as the copyright page in your products user manual. A comment in a script is not considered a visible location for the above notice.

If your situation requires the right sub-license your users for distribution of Marionet, special licensing and fees are required which vary depending on your specific needs. An example would be inclusion of Marionet with an authoring tool that your users use to create internet-enabled projects which they in turn distribute to others along with Marionet. In such a case, your users would also need a distribution license or you would need the right to sub-license your users for distibution under your distribution license.

  115. You may not include any documentation on the syntax of the Marionet commands with your product without express, written permission from Allegiant.

  117. Allegiant recognizes the last minute pressures of shipping a product and is prepared to work with you in an expeditious manner by fax and email, as appropriate, to facilitate the licensing of Marionet for your product.

  138. Corporations, schools, and other organizations may desire to install the Marionet application and Marionet Manager on a number of machines throughout their organization.

An example of this use would include a company-wide purchasing system, developed in-house, that used Marionet to send orders to a central processing group via email. In this example, each user of the system would need a copy of Marionet on their machine, but only the developers of the purchasing system would need the Marionet Developer's Kit. Once Marionet is installed, any number of additional solutions developed with Marionet could be deployed to these users without need of additional licensing.

  142. Another example would be a school computer lab that desired a copy of Marionet on each machine in the lab to run student projects.

  144. Another example would be a small workgroup of 5 or so users with a single internet connection on a workgroup server they were all connected too. A single copy of Marionet could be installed on the server where it could be shared by the entire workgroup.

  146. Allegiant will provide you with a disk and license number. You will run the installer on the provided disk and enter your license number, the installer will make a master copy of Marionet which you can then install on the number of machines your license provides for.

A Site License also allows you to place a single copy of Marionet on a workgroup server where multiple users on different machines may share it over the network. The license is the same, essentially you can choose to install Marionet on a specific number of machines or install a single copy which is used by a specific number of users.

Allegiant Technologies reserves the right to modify the licensing program discussed in this document at anytime, without notice. Before distributing a product, you should always obtain a current copy of this document for reference from http://www.allegiant.com/ or by sending a request to sales@allegiant.com.

All licenses are for the current version of Marionet, at the time the license is executed, and for any newer versions of Marionet released within a three (3) month grace period from the execution date of your license. If Allegiant releases any free updates for your licensed version of Marionet, those free updates are also covered even if released after the grace period expires.

  159. Licenses do not require renewal nor do they expire, but a new license (and payment of license fees) is required to include newer versions of Marionet not released within the grace period. Special upgrade pricing for licenses may be offered from time to time.
